MercadoIT offers technological solutions adapted to both companies and individual customers. In order to guarantee a clear, secure and customized buying experience, our sales conditions are divided into two categories:

  • B2B Customers (Business and Professional): Specific terms for business-to-business transactions, with special billing conditions, professional guarantees and access to services such as EOS/EOL.

  • Final Customers (Individuals): Conditions in accordance with current consumer regulations, including withdrawal rights, legal guarantees and after-sales service.

Identification of the company

2. Acceptance of conditions
Placing an order implies full acceptance of these general conditions, which are permanently available on our website.

3. Product Classification

  • REF: Refurbished
  • NIB: New, in unopened box
  • NOB: New, open box
  • WS: Cisco Wholesale Program Product

4. Right of withdrawal

  • You have the right to withdraw from your online purchase within 14 calendar days of receipt of the product, without justification and at no additional cost, except for return shipping costs if applicable.
  • To exercise this right, you can use the form available on our website https://mercadoit.com/soporte-rma.
  • The product must be returned in its original packaging and in a suitable condition for inspection.

5. Legal guarantee

  • All new products are covered by a 2-year legal warranty in accordance with European regulations.
  • Reconditioned products have a minimum warranty of 1 year, unless expressly indicated in the quotation.
  • Batteries and power supplies are warranted for 6 months.
  • This warranty does not cover damage due to electrical overload or misuse.

6. Delivery and transportation

  • The products will be delivered to the address indicated by the customer. MercadoIT assumes the risk until the order is received.
  • For orders over 200€ (Peninsula) or 600€ (Balearic Islands and rack cabinets), the transport cost will be paid by MercadoIT.

7. Verification of the order

  • We recommend that you check the condition of the product at the time of receipt. If you detect any physical damage, you have 7 calendar days to notify us in writing through our form https://mercadoit.com/soporte-rma.

8. Returns and RMA

  • To process incidents, returns or warranties, you can use the following online form https://mercadoit.com/soporte-rma.
  • If the error is attributable to MercadoIT or the product is under warranty, we will arrange a pick-up at no additional cost.
  • If the return is not justified, you must bear the logistical costs.

9. Methods of payment

  • Bank transfers, credit card payments and other secure methods are accepted. All payment information is processed through secure and encrypted systems (SSL).

10. Data Protection

Your personal data will be processed in accordance with the General Data Protection Regulation (EU) 2016/679. You can consult our privacy policy on our website.

11. Legislation and jurisdiction

These conditions are governed by Spanish law. In case of dispute, the courts of the consumer’s domicile shall have jurisdiction.

1. Application of conditions 

These conditions apply to all commercial transactions between MercadoIT S.L. and companies, distributors or professionals in the technology sector. 

2. Acceptance of the order 

The acceptance of quotations, orders or deliveries by the customer implies acceptance of these general conditions. The customer undertakes to comply with them in their entirety.

4. Verification of the goods 

  • The customer must verify the contents of the order at the time of receipt. 
  • Claims for discrepancies or defects will be accepted within 24 hours after delivery. 

5. Right of withdrawal

  • You have the right to withdraw from your online purchase within 14 calendar days of receipt of the product, without justification and at no additional cost, except for return shipping costs if applicable.

6. Warranties and performance 

  • Reconditioned equipment may have cosmetic marks without affecting performance. 
  • Standard 12-month warranty for servers, components and IT, extendable upon customer request. 
  • Lifetime warranty for Cisco, Arista, Juniper and Arpers transceivers networking equipment. 
  • 6 months for batteries and power supplies. 
  • IP Phones: 12 months. 
  • Warranties do not cover damage caused by electrical overload or misuse. 

7. Technical Support 

MercadoIT has a technical team available for consultation. The correct installation is the responsibility of the solution integrator.  

8. Deliveries and transportation 

  • For orders over 200€ (Peninsula) or 600€ (Balearic Islands and rack cabinets), the transport cost will be paid by MercadoIT. 
  • The risk of transportation is assumed by whoever hires the service. If it is managed by MercadoIT, we are responsible until delivery.  

9. Terms of payment 

Payments will be made on the basis of invoice date. 

10. Non-payments and cancellations 

  • The non-payment of any invoice will automatically expire all outstanding transactions. 
  • Cancellations will not be accepted if the product was ordered exclusively for the customer. 

11. Returns

  • You can make returns of your online purchase within 14 calendar days of receipt of the product, without justification and at no additional cost, except for return shipping costs if applicable. 
  • For offline orders, depending on the case, there may be a 30% depreciation. 
  • No returns will be accepted for customized material or material ordered exclusively for the customer.   
  • The customer must assume the shipping costs if the return is not attributable to MercadoIT. 

12. General conditions for technical support vouchers

  • Hours of operation: Service during normal business hours Monday through Friday.
  • After hours, night work, weekends or holidays not included, will be evaluated according to needs. 
  • Validity: Support vouchers are valid for one (1) year from the date of activation.
  • The hours not used in the planned activities may be used for other types of assistance within the period of validity.  
  • Fractions of an hour: For each intervention, the first full hour will be counted regardless of the time spent, and thereafter, fractions of thirty (30) minutes will be counted. 
  • Mode of assistance: The service will be provided remotely. If on-site work is required, the cost of travel will be assessed.  
  • Excess hours: In the event that the contracted hours limit is exceeded, you may choose to contract a new voucher or the additional hours will be billed according to the price/hour of the contracted voucher. 
  • Response time: Conventional assistance vouchers are intended for scheduled and pre-scheduled actions. If an unscheduled service is required, the service will depend on the availability of the technical team.  

13. Special conditions for EDS (Engineering Desk Service) support vouchers   

  • Response time: Rapid response service with SLA 8x5xSDH. Intervention will be initiated as far as possible on the same day of receipt of the request and at the latest on the next business day following receipt of the request. Requests for assistance received after hours will be considered received during the next first hour of service.  
  • As far as not specified in these special conditions, the general conditions of the support vouchers shall apply. 

14. Legislation and jurisdiction 

  • These conditions shall be governed by Spanish law in the event that any conflict or discrepancy arises in the interpretation or application of these general conditions, against a consumer, the competent courts shall be those of the domicile of the consumer. 
  • In the case of a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Valencia (Spain). 
  • The parties expressly submit to Spanish law and to the jurisdiction of the courts and tribunals of the city of Valencia for the resolution of any controversies or disputes that may arise from the execution or interpretation of the Order.
